1. Who We Are

PaintVue ("PaintVue," "we," "us," or "our") operates the AI-powered exterior paint visualization service available at paintvue.com. Our service lets homeowners preview their home in new paint colors using AI before committing to a project.

2. Acceptance of Terms

By accessing or using PaintVue, including creating an account, purchasing credits, or subscribing to a plan, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

We may update these terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the revised terms. We will note the effective date at the top of this page when changes are made.

3. Your Account

You must create an account to use PaintVue. You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Notify us immediately at hello@paintvue.com if you suspect unauthorized access.

You must be at least 18 years old to create an account and make purchases. By registering, you represent that you meet this requirement.

4. Credits and Payments

PaintVue uses a credit-based system for AI renders. Credits are purchased in packs via Stripe, our third-party payment processor. Pro plans are available by contacting us directly. Current pricing is listed on our Pricing page.

• New accounts receive 3 free credits upon sign-up, no credit card required.
• Purchased credits do not expire.
• Each render consumes one credit. Refinements are included with each render at no additional credit cost.
• Pro users receive custom render allotments as agreed upon enrollment.
• All payments are processed securely by Stripe. PaintVue does not store your payment card details.

Free signup credits are limited to one allotment per person or household. Creating multiple accounts, using disposable or throwaway email addresses, or otherwise attempting to obtain free credits beyond this limit is a violation of these Terms. We use automated signals, including email domain and network address, to detect this. Accounts we reasonably suspect of free-credit abuse may have their free credits withheld or suspended pending review. Purchased credits and paid plans are never affected.

If your account is flagged and you believe it is a mistake, you may dispute it from the render page or by emailing hello@paintvue.com. We review disputes within one business day and restore credits when a flag was raised in error.

5. Refund Policy

Because AI render credits are consumed immediately upon use, all purchases are final and non-refundable once credits have been used.

If you experience a technical failure (e.g., a render fails to produce an image through no fault of your own), contact us at hello@paintvue.com and we will review the situation and may issue replacement credits at our discretion.

For Pro plans, terms are agreed upon individually. Contact us at hello@paintvue.com with any questions about your plan.

6. AI-Generated Content

PaintVue uses third-party AI models to generate paint visualization images. By using the service, you acknowledge:

• AI renders are visualizations only. They are not architectural drawings, contractor bids, or color-match guarantees.
• Actual paint results may differ from AI-generated previews due to lighting, surface texture, paint brand, and application conditions.
• PaintVue makes no warranty that AI renders will be accurate, complete, or free from errors.
• You should not rely solely on a PaintVue render when making painting decisions. Always test physical paint samples before committing.

7. Your Content and Uploads

You retain ownership of any photos or images you upload to PaintVue. By uploading content, you grant PaintVue a limited, non-exclusive license to process and display your images solely to provide the service to you.

You must have the right to upload any images you submit. Do not upload images of properties you do not own or have authorization to use. Do not upload images that contain personally identifiable information of others without their consent.

We do not sell your uploaded images or use them to train AI models.

8. Marketing and Promotional Use

By uploading photos and generating renders through PaintVue, you grant PaintVue a non-exclusive, royalty-free, worldwide license to use your uploaded photos and AI-generated renders for marketing, promotional, and educational purposes. This includes, but is not limited to, use on social media, website galleries, blog posts, advertisements, and promotional materials.

No personally identifiable information, including your name, email address, or property address, will be shared publicly without your explicit written consent. Marketing use of renders will not include identifying details that could link a render to a specific individual or property.

If you do not wish your photos or renders to be used for promotional purposes, you may opt out at any time by contacting us at hello@paintvue.com. Upon receiving your request, we will remove your content from future marketing materials within a reasonable timeframe. Opting out does not affect your ability to use the service.

9. Acceptable Use

You agree not to:

• Use PaintVue for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to reverse-engineer, scrape, or circumvent any part of the service.
• Abuse the free credit system (e.g., creating multiple accounts to collect free credits).
• Upload content that is illegal, harmful, defamatory, or violates third-party rights.
• Interfere with or disrupt the security or integrity of the service.
• Use the service to generate content for fraudulent, deceptive, or misleading purposes.

We reserve the right to suspend or terminate accounts that violate these terms.

10. Intellectual Property

All PaintVue branding, software, design, and original content (excluding your uploaded images) are owned by PaintVue and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of PaintVue without our written permission.

AI-generated render images produced from your uploads are provided to you for personal or professional use related to your paint project. You may share them, but you may not resell them as standalone products.

11. Affiliate Links and Third-Party Products

PaintVue may display links to third-party products and services, including paint sample providers and home improvement retailers. Some of these links may be affiliate links, meaning PaintVue may earn a commission if you make a purchase through them at no additional cost to you.

PaintVue does not guarantee the quality, accuracy, or availability of any third-party products or services. Your purchase from a third-party provider is governed by that provider's own terms and policies.

12. Third-Party Services

PaintVue integrates with third-party services including Google (Maps, Gemini AI), Stripe (payments), Clerk (authentication), and SendGrid (email). Your use of these services is subject to their respective terms and privacy policies. PaintVue is not responsible for the practices of these third parties.

13. Disclaimer of Warranties

PaintVue is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that AI renders will meet your specific expectations.

14. Limitation of Liability

To the maximum extent permitted by law, PaintVue and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to costs incurred from acting on AI-generated visualizations.

Our total liability to you for any claim arising from use of PaintVue shall not exceed the amount you paid to PaintVue in the 90 days preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless PaintVue, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the service, your violation of these terms, or your infringement of any third-party rights.

16. Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Pennsylvania.
